Some of the proposals for improving the regulation of the energy market in the context of free market opening include greater transparency on consumer data and the sealing of brands and logo sharing, as well as infrastructure, within large groups that act in the distribution and in marketing.
The National Electric Energy Agency (Aneel) released in early February the Technical Note and Regulatory Impact Analysis (AIR) for the improvement of energy distribution amid the opening of the free hiring environment.
The suggestions are part of the third round of discussions on regulatory improvements for market opening.
The agency is expected to start a public consultation in February to discuss the proposals, which have passed five superintendencies within the regulatory body.
Early migration
Among the proposals are the possibility that the consumer opts for early migration, through an additional payment, and the reduction of the migration period from 180 to 90 days in the case of smaller customers.

To curb anticoncorrestial practices in the market, the agency suggested that distributors and traders of the same economic group are required to use different brands and logis, as well as the prohibition of infrastructure and human resources sharing.
According to the president of the Brazilian Association of Energy Consumers (Abraceel), Rodrigo Ferreira, one of the most important items that entered the suggestions of the agency was the regulation of Open Energy, the data sharing in the sector.

Competition
“In the competition market information is everything, especially in the 21st century. Well -processed, well -collected information is fundamental in developing business strategies, approach strategies and, moreover, is a right. The consumer has to have access to this information. This has to be standardized throughout Brazil, ”he says.

Aneel’s proposal provides for the regulation of Open Energy in two stages, the first to be in 2025, with the standardization of file formats and information to be made available to consumers. According to Ferreira, the model is in line with good international practices on the subject.
Tariff costs
It is also planned to open a sandbox – simulation of regulation – unified billing and the creation of a working group for the standardization of invoices.
Regarding tariff costs, cumulative tariff discounts were also proposed, as well as the end of irrigation and aquaculture discounts to free environment consumers.

In the free market, the consumer can choose the power supplier. Today, this option is restricted to the high voltage network, but the expectation is that in the coming years the market will also open consumers in low voltage, including residential.
“Aneel has played a key role in modernizing this market segment and this demonstrates how important it is to define a date [para a abertura]”Says the president of Abraceel.
Ferreira points out that it is essential to define a date for the total opening of the market by the Ministry of Mines and Energy (MME). According to the executive, the expectation is that this will occur in the first half of 2025.
“Everything starts to move from this, so we expect the government to now define a date for opening so that we can very clearly start to deal with it effectively,” he adds.
