Moraes denies pardon but gives semi -open to Daniel Silveira – 14/02/2025 – Power

The minister, of the (Supreme Federal Court), granted this Friday (14) the benefit of the semi-open regime to former federal deputy. Moraes, however, decided to deny the pardon request that had been requested by the former parliamentarian.

The defense tried that the former deputy benefited from the Christmas pardon.

“There is no doubt that the conviction for the crime provided for in Article 18 of the National Security Law, revoked by Article 359-L of the Penal Code, prevents the granting of the Christmas pardon,” said the Supreme Minister.

The scholarship was placed on parole at the end of last year, but was arrested again on December 24 by in Petrópolis (RJ) for breach of precautionary measures imposed on him.

“It turns out, however, that the custodian has failed the conditions set forth on several occasions,” said the minister.

The rapporteur mentioned that the former parliamentarian only came home at dawn on December 22, at 2:10 am. He was forbidden to leave the residence from 10 pm to 6am. It also cites the maintenance of a firearm when there is no registration certificate.

“Of course, that the sentenced on several opportunities disrespected the conditions set for the enjoyment of the conditional release benefit, so that it was not able to offer any minimally plausible argument for this, either through its technical defense or during the Justification hearing (self -defense), “said the minister.

Thus, Moraes stated that the previous decision to revoke the conditional release should be maintained because the explanations given by Silveira in a hearing do not rule out the conclusions previously pointed out.

Silveira was convicted in 2022 to eight years and nine months in prison, in a closed initial regime for threat to the Democratic Right of the right to promote attacks on court ministers and stimulate undemocratic acts. He also responds for coercion in the course of the process.

The day after the conviction, the then president () granted pardon to the deputy time. The former parliamentarian still launched the Senate candidacy in 2022 by the PTB-RJ, but was prevented from running.

In May 2023, the Court understood that there was a deviation of purpose in the granting of the pardon because the former deputy was Bolsonaro’s political ally and nullified the forgiveness.
