The Attorney General of the Republic (PGR), Paulo Gonet, defended the condemnation of former members of the Federal District Military Police (PMDF) summit by omission in the extremist acts of 8 January 2023.
The opinion, which appears in the final allegations of the criminal action in which the accused are defendants, was sent to the Supreme Court (STF) on Friday (14).
In the document, Gonet asks for the conviction of:
- Colonel Fábio Augusto Vieira
- Colonel Klepter Rosa Gonçalves
- Colonel Jorge Eduardo Naime Barreto
- Colonel Paulo José Ferreira de Sousa Bezerra
- Colonel Marcelo Casimiro Vasconcelos Rodrigues
- Major Flávio Silveira de Alencar
- Lieutenant Rafael Pereira Martins
In addition to the conviction, the prosecutor also argues that the loss of positions or functions eventually occupied by the accused be decreed.
“With regard to the case of the case, there is no doubt that the accused have adhered to the purpose of abolishing the Democratic Rule of Law and testifying the legitimately constituted government,” says an excerpt from Opinion.
“In addition to proving defendants’ participation in the dissemination of undemocratic content and other events (acts of 12.12.2022 and 24.12.2022), which already evidenced voluntary adherence to the undemocratic purposes of the group, is stamped in the file the purposeful omission of the accused regarding the use of the necessary staff of the Military Police to safeguard security and prevent the acts of depredation to the headquarters of the three powers. ”
The prosecutor cites the following crimes:
- attempted violent abolition of the Democratic Rule of Law;
- coup of state; Damage qualified by violence and serious threat, against the union’s assets and with considerable damage to the victim;
- deterioration of overturned assets;
- for violation of the duties imposed on them;
- for violation of contractual duty of guarantee and by interference of the standard.
The case will be released for judgment after the analysis of the PGR and defenses allegations by the rapporteur of the case, Minister Alexandre de Moraes.
