The Specialized Criminal Court (ŠTS), the Banská Bystrica workplace, dismissed on Monday the proposal of the lawfully convicted former judge of Žilina Pavel Polka and did not allow the renewal of the proceedings in his corruption case. In 2021, the STS sentenced it in 2021 for the guilt and punishment agreement for the continuing crime of taking bribes.
According to the court, the conditions of renewal of the proceedings are not met. At a public session, he did not identify and have not come to light such new facts and evidence that could justify a different decision on guilt than that is yet valid. Polka filed a complaint against the decision of the STS, which will be decided by the Supreme Court of the Slovak Republic. He refused to comment on the media.
“I consider the decision to be substantively, legal and justified. The self -judge explained the arguments that led her to this decision. At substantial points, even if she did not explicitly say it, she identified with the things I mentioned in the final proposal. He analyzed the testimonies from the criminal proceedings.
The exudience was accused of continuing the crime of receiving bribes and sentenced him to a three -year trial with a trial period of five years on the basis of a guilt and punishment agreement on the basis of a guilt and punishment agreement. He also received a fine of EUR 150,000. He confessed the guilt and regretted his actions.
Later, however, the former regional judge argued that he had made this agreement under pressure, is false and he is innocent. According to him, new facts are still based on the illegal procedure of the law enforcement authorities as well as the court itself. The illegality was supposed to be under the control of the Supervisory Prosecutor, who either covered them or committed them, so he also filed a number of criminal complaints. He objected to his bias and insisted to be heard as a witness what the self -judge dismissed.
The prosecutor identified his petition to authorize the resumption of the proceedings unfounded. Has excluded any pressure activities or unlawful procedures that should be forced to admit to some violence.
Polka was detained in September 2020 as part of the Plevel police and accused him of corruption crime. The amount of bribes received between 2014 and 2018 was to reach a total of more than EUR 100,000. He was allegedly shared, so he was directly about 40,000 euros. He took his and three other persons into custody.
