The deputy (PL-MG) filed a Legislative Decree project to convene a plebiscite about the elaboration of a new, to “restore and clearly define and the obligations, possibilities and limits” of the legislature, executive and judiciary.
The initiative occurs in a context in which the opposition complains of interference from the judiciary in the legislative process. There are also complaints to an alleged judicial persecution against pockets.
The project states that the plebiscite would occur at the same time as the first election carried out after the approval of the legislative decree.
In justification, the deputy states that, almost 40 years after the promulgation of, the country is different from Brazil of 1988. “Under a spirit was discussed the current constitution. We had a democratic, economic and social condition at that time,” he writes.
“Now, mature and with a new political and popular dynamic, it is worth a reflection on rights and duties, and clearly restores and define the obligations, possibilities and limits of each of the powers: Legislative, Executive and Judiciary.”
Sought by the panel, the deputy says there is a feeling in the House that the 1988 Constitution “has been exhausted.”
“It holds the development of Brazil and it is also no longer able to guarantee the harmony and independence of powers, nor embrace the particularities of Brazil in the face of the enormity of amendments that have been suffering over time.”
“Today we have another context that requires, in my view, a new debate. The referendum is precisely an opportunity to discuss this moment of the country and with the country.”
