The states argue that Musk exercises the type of power that can only be exercised by a government official who has been appointed by the president and confirmed by the US Senate in accordance with the US Constitution appointments clause. The states also claim that the creation of the DOGE was not authorized by Congress.

About 20 lawsuits were filed in several federal courts questioning the musk authority, which led to different results in two early decisions.
