The lawyers, former presidential advisor in the management of, filed two actions in the US to try to clarify the existence of records that would show his entry into the country at the end of 2022.
The records of American immigration in the state of Florida were used as an argument for Martins to be arrested for six months last year by order of STF Minister Alexandre de Moraes, who claimed that he could escape.
Geolocation records of his cell phone and credit card spending indicates that he is one of those indicted by the Federal Police in the inquiry of the alleged coup plot.
According to Martins lawyers, there was fraud in the US entry record.
On January 23, the former advisor’s defense sent a court order for Customs and Border Protection (CBP), American immigration, releasing the historical records in Martins, including metadata about who inserted, edited or removed any Information from all US entries and exits, even before its period in government.
There was also a presentation of a “Criminal Complantation”, a formal petition with the American judicial system to open a criminal investigation on the case.
