Now it is up to the Federal Supreme Court to decide whether or not to accept the complaint against Bolsonaro and 33 more accused
The Attorney General of the Republic, Paulo Gonet, denounced the former president (PL) and 33 more people involved in the investigation that investigates what would be an attempt to coup after the 2022 elections – vanished by the current president, (PT).
The complaint was sent to Minister Alexandre de Moraes, rapporteur of the investigation in the (Federal Supreme Court), on the night of this 3rd (18.FEV.2025). Also denounced the former minister and former vice on the Bolsonaro plate, General Braga Netto; and the former Assistant of Orders Mauro Cid
Those reported by Gonet respond for the crimes of Violent abolition of the democratic rule of law, coup and criminal organization. With this, Bolsonaro can take up to 28 years in prison.
Read below the penalty determined for each crime:
- violent abolition of the democratic rule of law – 4 to 8 years in prison;
- coup d’etat – 4 to 12 years in prison; and
- Integrate criminal organization – 3 to 8 years in prison.
Now the Supreme decides whether to accept the complaint and make defendants those indicated by PGR. In this case, they would respond to a criminal action in the court.
A criminal case involves hearings with the accused, interrogation and other steps. After the requirements and steps, the final allegations are made and the Court gives a decision on the penalties of each of those involved.
The Supreme can also send the case back to the first instance – in case a possible prison of Bolsonaro would be longer.
PF INDICIATION
The PF (Federal Police) Bolsonaro, the candidate for deputy and former defense minister, General Braga Netto, former orders of orders, Lieutenant Colonel Mauro Cid, and 34 people on November 21 last year. On December 11, the corporation plus 3 people among the accused, totaling 40.
In the document, the PF claims to have identified what would be evidence throughout the investigation that show in a “Unmistakable” that Bolsonaro “He planned, acted and had directly and effectively dominance of the executory acts performed by the criminal organization that aimed to realize the coup d’état and the abolition of the Democratic Rule of Law”.
The evidence against those involved were obtained by the PF over almost 2 years, through breaks of telematic, telephone, banking and fiscal secrecy, as well as award -winning collaborations, searches and seizures.
The objective of the group involved, graduated in short by military, would be prevent the president -elect’s inauguration to replace Bolsonaro in power. However, according to the corporation, there would still be a plan to kill Lula, his deputy (PSB) and arrest or execute STF Minister Alexandre de Moraes.
The PF counter -counter operation arrested 4 military personnel when issued on November 19, 2024. Investigations also led to the arrest of General Braga Netto, of the findings.
