The minister, a member of the Federal Supreme Court (), decided on Thursday (20) that the 34 individuals reported in the coup-related investigation will have access to evidence of investigations that were under confidential. These investigations address topics such as the misuse of the Brazilian Intelligence Agency () and the performance of the Federal Highway Police () to influence the result of the 2022 elections, in addition to the events that took place on January 8. The authorization was granted in response to a request from the Attorney General’s Office (PGR), which argued the need for defenses to have access to the data that underlined the complaint.
“I authorize all defenses broad access to the evidence already documented in Pets 11.108, 11.552, 11.781, 12.159, 12.732, to full knowledge of investigations related to the accused, except for access to diligence in progress,” wrote the minister. The Attorney General took the initiative to request the sharing of the information before the lawyers of the complaints made this request formally.
In previous investigations, the former president (PL) and his supporters raised questions about the confidentiality of documents, arguing that this limited the right to broad defense.
