The Ministry of Justice (MS) of the Slovak Republic rejects the opposition’s claims on the amendment to the Act on Judges and Judges. According to the Ministry, one of the priorities of the proposed legislation is to ensure the basic principles of court proceedings as a guarantee of the right to a fair trial. He rejects political control of judges. For TASR, this was stated in response to the opposition MP (SaS) spokeswoman Barbora Škulová.
“Criticism on the bill that is currently in the comment procedure is a misunderstanding of the basic philosophy, which meets the requirements of procedural justice by introducing the opportunity to review sanctions in disciplinary proceedings in the proper remedy, “Škulová said.
She added that If it is not possible to review the sanctions in disciplinary proceedings in the proper remedy, this may have a serious impact on the status and the general and social status of the judge in the event of a faulty unfair process. The resort explained that the aim is to strengthen the appeal principle, thus ensuring the possibility of appeal against any decision of the Disciplinary Senate. “The two -instance disciplinary proceedings were approved in the Czech Republic last year and we are now proposing it in an amendment to the Act on Judge and Judges,” the spokeswoman of the World Championship said.

Opposition MP Mária Kolíková pointed out on Thursday that the amendment to the Act on Judges and Awarders, which was submitted by the Ministry of Justice, is fundamentally changing the occupation of the Supreme Administrative Court disciplinary senates, which decides whether or not to mistake the judge. Their selection could be decided by the Judicial Council of the Slovak Republic. Kolíková described this proposed change as dangerous, because the Judicial Council will be able to decide which judges are comfortable and uncomfortable for her.
