Minister Alexandre de Moraes of the Federal Supreme Court (STF) denied a request submitted by the defense of former President Jair Bolsonaro (PL) to extend the period of response to the complaint presented by the Attorney General’s Office (PGR). With this, the deadline remains 15 days.

Earlier, Bolsonaro’s lawyers had made a number of requests to change this deadline. The first was a suspension until they have “access to the full and used test”. It was also requested that the defendant’s defense only submits his position after Lieutenant Colonel Mauro Cid, who was also denounced, but which closed award-winning agreement.
A period of 83 days was also requested, the same as the PGR had to submit the complaint, after the Federal Police report (PF), presented in November last year. In addition, lawyers requested a double term, as the process has several defendants.
All requests were denied by Moraes. According to the minister, “the broad and integral access to the evidence already documented in the file is fully guaranteed to the defense of the investigated”.
Regarding the presentation of the demonstration after the rapporteur, Moraes argued that this is only valid for criminal action, a later phase of the process, if the complaint is accepted. Already the alternative deadlines required “lack any legal provision, because the legislation provides for a period of 15 (fifteen) days,” said the minister.

PGR reported to the Bolsonaro Supreme Court, former Minister Walter Braga Netto and 32 more people for a coup plot to keep him in power after being defeated by Luiz Inacio Lula da Silva in the 2022 elections. The complaint was offered by the prosecutor -General of the Republic, Paulo Gonet, and will be appreciated by the first class of the Court after being released by the rapporteur, Minister Alexandre de Moraes.
According to the prosecution, Bolsonaro committed crimes of armed criminal organization, coup, attempted abolition of the Democratic Rule of Law, damage qualified by violence and serious threat against union patrimony and deterioration of overturned assets.
Why was Bolsonaro denounced by PGR?
According to PGR, Bolsonaro “led” criminal organization that tried to coup. “The responsibility for acts harmful to the democratic order is on criminal organization led by Jair Messias Bolsonaro, based on authoritarian project of power,” Gonet wrote in the complaint.
According to the PGR, the alleged criminal organization was “rooted in the state structure itself” and had “strong influence of military sectors.”
