The House of Representatives analyzes a bill that typifies sentimental estelionate as a crime of high offensive potential, making it a separate offense and increasing its penalty. The proposal defines this type of estelionate as the simulation of a love relationship for the victim’s economic or material advantage. Here’s the PL 69/25 (PDF – 140kb).
The penalty is imprisonment 3 to 8 years and fine. The sanction will be increased by 1/3 if the estelionaire uses false profiles on social networks or relationship applications for crime. Against the elderly, the imprisonment penalty increases to 4 to 10 years.
One of the authors of the proposition, deputy (PP-AC), evaluates the sentimental estelionato as “A Prague” which represents one of the emotionally devastating offenses of today. The proposal was presented with 10 other parliamentarians.
“The vulnerability of the victims is exacerbated by the emotional and psychological manipulation to which they are subjected, which makes them easy targets for unscrupulous criminals.”says Socorro Neri. “Victims, often emotionally weakened, need robust and immediate protection. Only a severe law can reduce the index of this type of crime. ”
The project changes the Penal Code to include crime separately from the ordinary estelionate. It also alters the Maria da Penha Law to include crime as a form of domestic and family violence against women and even the Elderly Statute.

The project will be analyzed by the Committees of Defense of Women’s Rights; Defense of the rights of the elderly; and constitution and justice and citizenship, before being voted by the House Plenary.
