Mario Frias becomes defendant for promoting fake news about Lula in 2022

São Paulo accepted a complaint against the federal deputy (PL-SP) for disclosing false information about the president (PT) during the 2022 elections.

The criminal action was opened by Judge Cecilia Pinheiro da Fonseca, from the 6th Electoral Court of São Paulo, from the complaint of the MPE (Electoral Public Prosecution Service). Read A (PDF – 492 KB).

During the election campaign, Frias shared an image comparing Lula, which wore a cap with the acronym “CPX”, and then President Jair Bolsonaro (PL), which wore a PRF (Federal Highway Police) cap. The publication stated, deceptively, that “CPX” meant “Cupincha”term associated with organized crime.

According to the MPE, the acronym is an abbreviation of “Complex”in reference to communities of Rio de Janeiro. The cap was produced by residents of Complexo do Alemão and presented to Lula during the campaign.

In the action, prosecutor Silvio Marques argues that the publication of Frias sought to associate Lula with criminal factions of Rio de Janeiro to influence the electorate against the then candidate.

In accepting the complaint, the judge considered to have “Proof of criminal materiality and sufficient evidence of authorship” for opening the process. As a defendant, Mario Frias should present his defense.
