The Federal Court of the Federal District ended the process arising from the against former Finance Minister Guido Mantega by prescription. He was responsible for crimes against the tax order.
In a decision last Friday (21), Judge Antonio Claudio Macedo da Silva considered the age of Mantega. As he is over 70 years old, the deadline for prescription falls in half.
“Indeed, between the date of receipt of the complaint and the present date has already flown the interstice beyond what is necessary for the prescription,” said the holder of the 10th Federal Court of Brasilia.
The crime to which Mantega responded provides for a maximum penalty of four years. By the Penal Code, the possibility of punishing a defendant framed in these cases after eight years. When the defendant is over 70 years old, the deadline is four years.
The former minister was reported in November 2017 by the Attorney’s Office in the Federal District. Judge Vallisney Oliveira, then head of the 10th Federal Court, in March 2018.
The request for prescription was made by the defense of the former minister and recognized by the prosecutor.
In addition to him, the prosecutors denounced 13 people. The judge accepted the complaint in full, but excluded the former president of Carf (Administrative Council of Tax Appeals) Otacilio Cartaxo, killed during the case.
The complaint results from an investigation into manipulation of the composition and the operation of the Superior Council of Tax Resources, a carf agency linked to the farm, to favor the company Cimentos Penha in an operation of R $ 57.7 million.
Carf is a council linked to the Ministry of Finance, whose assignment is to analyze funds from companies fined by the IRS. The agency has been investigated by Zelotes since 2015 on suspicions of voting for votes at the board sessions.
