“Today, the United States Court for the Florida Middle District has confirmed what we have defended from the beginning: Judge Alexandre de Moraes’s censorship orders have no legal strength in the United States. This decision is a total victory for freedom of expression, digital sovereignty and the law of US companies to operate without foreign legal interference.

“The court explicitly determined that the Moraes directives have never adequately attended to US or international laws, maintaining that they were not delivered through the Hague Convention, the US-Brazil’s Mutual Assistance Treaty (Mlat) or any other Valid legal mechanism. This means that Rumble and Trump Media have no obligation to comply with these illegal censorship requirements and no US entity is required to apply them.

“The court also made it clear that if anyone tries to apply illegal orders to US soil, they will be ready to intervene to protect US companies and freedom of expression. The decision sends a strong message to foreign governments that they cannot circumvent US law to censor US platforms.

“This case never said about Rumble or Trump Media – respect to prevent foreign judges from trying to silence [liberdade] expression in the United States. “Rumble and Trump Media will continue to fight for freedom of expression, and today’s decision is an important victory in this battle.”

RUMBLE SUSPENSION

STF Minister Alexandre de Moraes ordered Rumble’s suspension in Brazil after the platform did not comply with judicial decisions. They are:

  • the removal of the profiles of journalist Allan dos Santos on the social network;
  • Blocking the financial transfers received by him through advertising, registration of supporters and donations on the platform; and
  • The indication and proof of a legal representative of the company in Brazil.

The social network, which returned to Brazil on February 8, was summoned by the minister to block the journalist’s accounts. At the time, the company’s lawyers responded that they had no legal powers to be summoned on behalf of Rumble Brazil and resigned.

Moraes then asked the Canadian company to indicate a legal representative in Brazil. In the order, the Minister of the Court cites that this figure is a requirement for a company based abroad to operate in Brazil.
