Alcohumbre waves to the Supreme Court after Dino’s decision on amendments

Senate and National Congress President David Alcolumbre (Brazil-AP Union), celebrated this Wednesday (26.FEV.2025) the decision of the STF Minister, Flávio Dino, of. With the act, the Court authorized the resumption of transfers of the budget of 2025 and past years.

In a document sent earlier to the Court by the AGU (Attorney General of the Union), Senate, Chamber and the Government pledged to nominally identify the congressmen’s authors and supporters of the amendments. Leia a do document (PDF – 620 KB).

In addition to the identification of parliamentarians, the houses also promise to standardize and structure the data regarding the parliamentary amendments of bench (RP7), Commission (RP8), and the old rapporteur amendments (RP9).

In relation to Commission Amendments for the year 2025the plan promises:

• standardize minutes and spreadsheets;
• Identify, nothe name of parliamentarians who request and support the amendments;
• Disseminate in easily accessible link and consult all minutes and spreadsheets of the House and Senate permanent committees.

Already in reference to bench amendmentsalso in Exercise of 2025the plan proposes:

• Identify the proponent parliamentarians on the Transparency Portal, with a direct link to the amendment detail, released on the website (Mixed Commission of Plans, Public Budgets and Inspection);
• standardize minutes and spreadsheets;
• Make available on the CMO website the minutes and worksheets of the state benches that approve the amendments, as well as the indication for their execution.

Dino’s decision will be analyzed at the STF plenary. The meeting with the three powers that was scheduled for Thursday (27.FEV) was canceled. The magistrate authorized the transfers with exceptionssuch as those with technical impediments or court order.

Regarding committee amendments regarding the years 2022 to 2024, the general orientation is to expand transparency, integrating information on amendment supporters and making the data available in the “Parliamentary Amendment Support System” system. The same is proposed in relation to the amendments of rapporteur of the 2020s, 2021 and 2022.

Congressmen’s amendments have been the target of a series of Dino decisions since August 2024, which culminated in the suspension of the imposing amendments, whose payment is mandatory by the government. The authorization was maintained only in cases of public calamity and works already in progress.

The three powers crashed into the execution of the amendments. The Supreme Court says that transparency and traceability rules are lacking to identify who indicates them and how resources are used at the end.

Congressmen see the position of the Court as an improper interference in the legislature.
