Justice requires farm to release BPX group operations

Federal Judge Pablo Zuniga Dourado, of the TRF-1 (Federal Regional Court of the 1st Region), determined on Wednesday (26.FEV.2025) that the SPA/MF (Secretariat of Prizes and bets of the Ministry of Finance) ensures the inclusion of the list of operators authorized to make fixed shares in Brazil. Dourado determined a daily fine of R $ 50,000 in case of non -compliance. Here’s (PDF – 147 kb).

The court order complies with a claim (an interlocutory appeal) of BPX Bets Sports Group, responsible for the brands Vaidebet, Obabet and Betpix365. The company claimed that the SPA/MF had not complied within the period established the previous determination of 14 February of inclusion of brands in the list of authorized operators.

The federal judge emphasized the importance of respecting judicial deadlines, given the urgency of the measure and its impact on the economic activity of the parties involved.

The resistance of the farm to abide by the decision was classified by Dourado as a “Unjustified inertia”. The judge pointed out that, despite the complexity of administrative procedures, this does not justify the breach of court orders.

The dispute began in October 2024, when the AGU (Attorney General of the Union) excluded BPX Bets Sports Group from the list of companies authorized to operate during the adaptation period, citing the preservation of public interest and administrative morality. The decision was based on criminal suspicions involving José André da Rocha Neto, the company’s majority partner.

However, in January 2025, federal judge João Moreira Pessoa of Azambuja partially granted a request from BPX Bets Sports Group to be able to operate. There were a number of resources from both the Union and the company. On February 14, the TRF-1 granted an injunction to the BPX group, determining that SPA/MF authorized the operation of the brands Vaidebet, Obabet and Betpix365. The new decision, of Wednesday (26.FEV), reinforces this determination.
