The minister of the (Federal Supreme Court) told federal deputies in reserved conversations that there are today more than 80 open inquiries in the Court to investigate complaints and possible irregularities involving the budget.
The speech served to defend the need to disclose the names of those responsible for the nomination of resources, amid him of blocking these funds.
Although on Wednesday (26), which parliamentarians saw as an end to the clash with the Supreme Court around the subject, the existence of these inquiries can resume the crisis in the future, with the progress of investigations and operations.
The exact number of inquiries is unknown because the processes are confidential and under the rapporteur of different ministers in the Supreme. Dino also clarified this group of deputies that there are parliamentarians who respond to more than one inquiry, without citing names, and therefore would not be 80 congressmen under investigation.
In Wednesday’s decision, Dino made it clear that the understanding between the three powers to release the execution of the amendments will not mean that investigations into deviations and misuse of public money will be closed.
“[O desbloqueio das emendas] It does not harm the inquiries and lawsuits in which any specific cases of unmixed practices are analyzed, so that the corresponding sanctions are applied, such as the nation’s interest, always observed due process of law, on a case by case basis, “he wrote in the sentence.
Likewise, he ordered the Federal Court of Auditors) and the (Comptroller General of the Union) to follow the audits and preparation of technical report that will scrutinize the way money is being used.
It was these audits, for example, who pointed to the technical inability of NGOs to perform the resources received and exposed delays and problems in works of small municipalities that were irrigated with money from the federal budget.
The approximate number of inquiries was informed by the minister at lunch with congressmen last week, in a kind of “DR” about amendments. Since last year, the two powers have been tensioned in front of one to increase transparency and traceability of the transfers and that have paralyzed the execution of amendments.
Although the objective of being achieved, the complaints of Congress will still be frequent and the line between tension and harmony will remain tenuous, in the evaluation of STF members.
According to these ministers, there is still a certain resistance of parliamentarians to measures to increase transparency of transfers, and the fact that there are more than 80 surveys with deputies and senators in the mira leaves many of them tense.
The existence of dozens of inquiries was also confirmed by Minister Gilmar Mendes, during a coffee with journalists, in the Supreme Court, on Thursday night (27). The minister stated that there is a “very unique political context” involving amendments and that is why it is necessary to “order” the question.
“Obviously this has consequences. It cannot be said that everyone operates improperly, that they may be using with electoral interest and only. But we have these inquiries there, I don’t know if they are 60 or 80,” he said.
The opening of an investigation last year on a letter signed by almost all leaders to refer to the government to allocate the amendments was even questioned during lunch – and Dino replied that he is not necessarily investigating party leaders just because they signed a document, but investigating irregularities involving budget amendments.
The lunch occurred at the house of the former mayor, and was attended by leaders such as Aureo Ribeiro (Solidarity-RJ), Doctor Luizinho (PP-RJ), Mario Heringer (PDT-MG), Paulinho da Força (SP), president of Solidarity, and Lindbergh Farias (PT-RJ), among others.
Gilmar was also one of the participants of the meeting. And Dias Toffoli were invited, but could not attend.
According to who was present, Gilmar would have heard more than spoken. And, according to reports, he pointed out that the findings involving the amendments are not a new Lava Jato operation.
The general mood of the meeting was relaxed and distemant. But there were also moments of tension, such as when deputy Elmar Nascimento (União Brasil-BA), one of those mentioned in Operation Overclean of the Federal Police, which.
One of the participants used the expression in Latin Jus Sperniandi to summarize the meeting, which speaks of the right to complain or complain.
In another tense moment, Dino – which was once deputy, senator, governor and minister of state – pointed out that he understands their side and that it was already of politics, but today is a judge. And he added that while receiving complaints, he will open inquiries and will not prevaricate.
Lunch has been one of several meetings since January between the Congress summit and Dino to treat amendments and reach a consensus. Despite not having attended the meeting at Maia’s house, the mayor, (-PB), was part of this agreement.
The conversations culminated on Tuesday, in which the commitment to individually disclose the names of each amendment. Dino approved the proposal the next day and released part of the payment and execution of the funds that were locked, and cancel the conciliation hearing that would take place on Thursday.
Motta and (Brazil-AP Union), president of, celebrated the decision and stressed that it is the result of dialogue. The mayor also spoke of respect for parliamentary prerogatives. Party leaders also praised the result and saw the conclusion of the crisis as “excellent”.
The magistrate, however, maintained caveats previously imposed, such as suspensions regarding the NGOs of third sector entities and the requirement of work plan so that direct transfers to states and municipalities, popularly called pix amendments, are paid.
