The defense of the former federal deputy asked Minister Alexandre de Moraes of the Federal Supreme Court (STF), authorization to temporarily leave the semi-open regime and visit the family during the Easter holiday. The request was filed on Friday (28) and is still awaiting analysis of the minister, who can refer him to the Attorney General’s Office (PGR) to issue an opinion.
Silveira was sentenced to 8 years and 9 months in prison for attempted to prevent, with violence or serious threat, the free exercise of the powers of the Union and for coercion in the course of the process. Currently, he is in a semi -open sentence and performs daily to the Marco Aurélio Vergas Tavares de Mattos Agricultural Colony in Magé (RJ).
In the petition, the defense maintains that Silveira is in the process of resocialization, has no disciplinary absences and maintains exemplary behavior. Lawyer Michael Robert argues that the former deputy does not pose a risk to public order and that the temporary exit would allow him to visit his mother, daughters and the companion.
The request, however, occurs in the midst of a political clash. While Silveira’s defense claims the benefit provided for in criminal law, Bolsonarist allies in Congress advocate the end of the “Saidinhas” for semi -open prisoners. The theme is under discussion in the Senate, with one.
Prison comings and goings
Silveira returned to arrest in December 2024, after, as the obligation to wear an electronic anklet and the ban on accessing social networks.
The former deputy received a presidential pardon from Jair Bolsonaro (PL) in April 2022, nullifying his conviction. However, in 2023, the Supreme Court overturned the measure because it considered it unconstitutional and determined its immediate arrest.
