According to the Minister of the Federal Attorney General, the understanding allows the elaboration of a new plan to resume construction of Angra 3
The Minister of AGU (General Advocacy of the Union), Jorge Messias, said that between União and Eletrobras will result in “Creation of the conditions for rescue of nuclear energy production in Brazil”. According to the agreement, the Union will increase its presence from one to 3 of the 10 chairs in the Eletrobras Decision Committee. It will also snap 1 of the 5 seats in the Fiscal Council.
On the other hand, Eletrobras has succeeded in suspending its investment obligations in Eletronuclear. According to the relevant fact of the company, a new process will be opened at the CCAF (Chamber of Mediation and Conciliation of the Federal Public Administration) of the Supreme Court (Supreme Court) to deal with the investment plan to complete the Nuclear Plant of Angra 3 and the contributions that Eletrobras should make if the government decides to continue the venture. In, the Union said that the agreement also provides for a contribution of R $ 2.4 billion to “modernization and expansion of the nuclear plant of Angra 1”. This amount will result from debentures to be issued by the electronuclear.
According to Messiah, the understanding “It allows a relevant participation of the Union in the governance of the company, but maintains the sovereignty of the decisions of the assemblies in Eletrobras, as projected in the privatization law”.
The AGU minister said that, with the agreement, the electronuclear “will be able to elaborate a new project for the resumption of the construction of Angra 3”, With“cooperation of Eletrobras or another company interested”.

The case involves the constitutionality of part of the rule that authorized the privatization of Eletrobras, approved by the National Congress and sanctioned by the then president (PL).
Last year, AGU filed a lawsuit in the Supreme Court asking for the overthrow of the law that restricts to 10% of the shares the vote of any shareholder in the board of directors of Eletrobras.
AGU argued that the rule is unconstitutional and contradictory, as it discourages its own private investment in Eletrobras. For the agency, the standard was exclusive to the Union, which would currently be the only shareholder with more than 10% of the company.
