From now on, the transfer of parliamentary amendments will require clear justifications

The (STF) should conclude on Wednesday (5) the judgment on the transparency of those, a theme that has generated intense debates in the Brazilian political scenario. The minister’s decision, who proposed a homologation plan for the transfer and traceability of these amendments, was unanimously accepted by the Ministers of the Court. This trial, which began last Friday (28) in Virtual Plenary, aims to implement more rigorous criteria for the amendments included in the Union’s annual budget from 2025. With the decision, the payment of amendments will be released after the approval of the Supreme Court, resulting from an agreement between the Supreme Court, the National Congress and the Executive.

From now on, the transfer of parliamentary amendments will require clear justifications, identifying the responsible parliamentarian and the benefited entity. However, some amendments remain blocked, such as those destined to NGOs and third sector entities that have been audited by the Union Comptroller, as well as health resources that are not regularized in specific accounts. The impasse on parliamentary amendments dates back to 2022, when the Supreme Court declared the unconstitutionality of RP and RP9 amendments, known as the secret budget. In response, the Congress promised new rules, but the PSOL Party questioned the irregularity of the transparency of these amendments, leading to the suspension of several of them by Minister Flávio Dino.

The decision of the Supreme Court has significant implications for Brazilian policy, highlighting the need for greater supervision and transparency in the use of parliamentary amendments. The value of these amendments has grown substantially, from R $ 6.1 billion in 2014 to a forecast of R $ 52 billion in 2025. The approval of new criteria by the Supreme Court seeks to ensure more rigorous control over these resources, which have been used as a political negotiation tool by the government.
