Bolsonaro defense deadline ends this Thursday (6)

The defense of the former president Jair Bolsonaro (PL) has until this Thursday (6) to respond to the complaint of the Attorney General’s Office (PGR) in the Federal Supreme Court (STF).

The former Mandanitor is accused of involvement in a supposed plot for a coup d’etat after the 2022 elections.

Bolsonaro lawyers requested the expansion of the deadline for response, but the rapporteur of the case, Minister Alexandre de Moraes,

The defense claimed a period of 83 daysarguing that this was the time used by PGR to formulate the complaint. In addition, I claimed not to have access to all process documents.

Moraes, however, rejected the request, stating that there “Integral access to the case and the system” and to all available test elements.

With this, the former president’s team must file their demonstration by the end of Thursday.

Accusations

For the Attorney’s Office, Bolsonaro committed the following crimes:

  • Armed criminal organization;
  • Attempted violent abolition of the Democratic Rule of Law;
  • Coup d’etat;
  • Damage qualified by violence and serious threat against the union’s assets, with considerable;
  • Deterioration of listed assets.

Different deadlines

Not all 34 accused have the same response period. This is the case of the former Defense Minister that can speak up until Friday (7).

This difference is not an extension of time, but the moment each was summoned. Bolsonaro received his subpoena on February 19, with a period of 15 days ending on Thursday.

Already Braga Netto was summoned one day later, on February 20, and therefore has until Friday to respond.

Impediment request

In addition to the request to extend the deadline, Bolsonaro’s lawyers asked the ministers Flávio Dino and Cristiano Zanin to declare themselves prevented from judging the case.

The defense claims that Dino could not be impartial, because in 2021, when he was governor of Maranhão, he filed a criminal complaint against Bolsonaro.

At the time, the then president accused the governor not to use the Military Police to reinforce security during his visit to the state.

About Zanin, the defense of the former president argued that he acted as a lawyer of the PT and President Luiz Inacio Lula da Silva (PT).

And that in a process related to the 2022 elections, he declared himself prevented from judging by defending the party at the time.

The case will be tried by the first class of the Supreme Court, composed by Alexandre de Moraes, Flávio Dino, Cristiano Zanin, Cármen Lúcia and Luiz Fux.
