Joana Mascarenhas was punished by the local Criminal Court of Lisbon in October 2024, to two and a half years in prison, suspended in her execution for three years for a crime of domestic violence.
The Lisbon Court of Appeal (TRL) confirmed the sentence to the suspended penalty of arrest of the influencer who, in 2023, plunged his three -year -old daughter in cold water to stop tantrum.
According to the judgment, which the Lusa agency was accessed today, the woman was punished by the local Criminal Court of Lisbon, in October 2024, to two and a half years in prison, suspended in her execution for three years for a crime of domestic violence.
Joana Mascarenhas, 36, was still forced to compensate the child in a thousand euros.
In the trial, it was shown that, with the purpose that the daughter stopped making a tantrum, the influencer plunged, at first, the girl to the chin in the pool of the building where they reside, and, days later, wet her with cold water, at dawn and the pajama dressed in a home shower.
In the TRL appeal, the defendant’s defense claimed that “there is no proof” that he knew he was mistreating the child, having acted convinced, due to a text he had read on the internet, that water has relaxing properties.
The argument was, however, rejected by TRL.
“It is not believable that any father or medium careful mother, empathic, worried to your son believe that he is here before something innocuous, good or lawful,” they maintain, in the judgment of February 20, the judges judges.
Still, the magistrates accessed three punctual changes in the facts given as proven, stressing that none significantly interferes “in what had been determined by the local Criminal Court of Lisbon.
Among the added acts is the explanation that “the defendant maintains with her daughter a relationship that is generally of loving and loving affinity.”
The case was made public after in July 2023 the influencer has released on social networks the way his daughter’s tantrums had crashed.
In the trial, it was proved that they were isolated acts and that the child did not have psychological sequelae of the violence suffered.
