The request had been made by the then candidate for the City Hall (), after Tarcisio claimed, without evidence, that members of the criminal faction would have guided family members and supporters to vote in the psoilist in the second round of the municipal election.
The then PSOL candidate reacted, classified the declaration as a criminal and filed a lawsuit asking for the ineligibility of Tarcisio and the mayor (), supported by the governor.
In the decision, signed last Saturday (1st), Judge Antonio Maria Patiño Zorz, of the 1st Electoral Zone of the state capital, said that the accusations against Tarcisio were not proven and do not constitute abuse of power.
According to the magistrate, Tarcisio did not use the state structure during the interview, which was not called by him either. In addition, the decision points out that the practice of making statements to the press is common and is not prohibited by the Electoral Court.
Patiño concluded that there was no deviation of function of the media or illegal conduct by the governor. For the judge, the interview was not enough gravity to compromise the normality and legitimacy of the claim.
Tarcisio’s statement was made at Miguel de Cervantes College, in the south of the capital, where he voted alongside Nunes.
When talking about violence, he said: “There was interception of conversations and guidelines that were emanating from prisons by a criminal faction, directing certain people from certain areas to vote for certain candidates.”
