Army General Augusto Heleno, former Minister of the Institutional Security Office (GSI), asked on Thursday (6) summary acquittal to the Supreme Court (STF).
The request was made through the demonstration sent by the military’s lawyers to the STF about the complaint of the coup plot during the government of former President Jair Bolsonaro.
Heleno was denounced by the Attorney General’s Office (PGR) in the investigation that found the attempted coup d’état in 2022 to prevent the third term of President Luiz Inacio Lula da Silva. .
According to the general’s defense, there are no “minimal elements” that point out direct or indirect involvement of him with the facts cited in the prosecution.
“There is no witness who points out his involvement, there is no WhatsApp conversation for anyone for anyone dealing with the criminal venture reported here. It requires that the present complaint be tried inept for the reasons and reasons set forth above and, if received, the accused of these exact reasons, the defense requested.
Defense period
The deadline for delivering the defense of most accused ends on Thursday (6), except in the case of General Braga Netto and Admiral Almir Garnier, who have until tomorrow (7) to comment on the complaint.

Judgment
After the delivery of all defenses, the judgment of the complaint will be marked by the Supreme Court.
The case will be tried by the first class of the Supreme. The board is composed by the report rapporteur, Alexandre de Moraes, and the ministers Flávio Dino, Cristiano Zanin, Cármen Lúcia and Luiz Fux.
Under the Court’s Rules of Procedure, it is up to the two classes of the Court to judge criminal proceedings. As the rapporteur is part of the first class, the prosecution will be judged by the board.

If most ministers accept the complaint, Bolsonaro and the other accused have become defendants and respond to a criminal case in the Supreme Court.
The judgment date has not yet been set. Considering the legal procedures, the case can be tried in this first half of 2025.
