The TJ-PB (Court of Justice of) unanimously approved a retroactive payment of R $ 234 million to judges and judges of the state.

The decision was endorsed by the Special Body of the TJ-PB at an extraordinary administrative session held on February 26. The vote lasted 24 seconds.

The amount refers to an indemnity for “accumulation of procedural collection” from January 2015 to April 2022. According to the list of beneficiaries in the process, 281 magistrates must benefit with individual values ​​that reach, at most, to R $ 957 thousand.

Asked, the TJ-PB reported that there was no payment made and there is no provision for it to be made, as it is conditioned to the authorization of the (National Council of Justice) and the availability “that always acts with fiscal responsibility and budget balance”.

The court added that “the CNJ, through recommendation 75/2020, determined the extent of this right to state judiciary, correcting an earlier omission.” “Administrative recognition reaches magistrates who acted between 15/01/2015 and 30/04/2022 in condition of accumulation of collection without proper compensation.”

The accumulation of collection is the expression used to define extra payments to judges that assume cases left by other magistrates.

Sought by the report, the CNJ said that the indemnity amount corresponds to “one third of the magistrate’s allowance designated for replacement for every 30 days of cumulative designation exercise and will be paid for a proportional service time”.

“Accumulation occurs in the exercise of jurisdiction in more than one judicial body, as in cases of simultaneous action in different courts, and by procedural collection, with the total of actions distributed and linked to the magistrate.”

The payment of the indemnity was required by AMPB (Paraíba Magistrates Association). According to the request, the argument was that the accumulation of procedural collection generated a work overload for the magistrates, which would justify financial compensation.

The period of this accumulation would begin in accordance with the sanctions of Laws 13,093 and 13,095, which created these bonuses for federal and labor judges, regulated by the CNJ in 2020. Paraíba only implemented in 2022.
