It was necessary to reach 2025 to know the final verdict of an episode that took place on November 29, 2019. Emilia C., at the age of 63, had gone to Pingo Doce de Matosinhos having a coffee, on a rain afternoon across the country. Inside the store, the floor was slippery and Emilia C. “slipped and fell helplessly on the supermarket floor.”
These last words can be read in the facts described in that of the Supreme Court. In the same document, it is found that “the fall was exclusively for the floor to be wet and slippery, since the author wore the usual shoe and already passed by, on other occasions and with the same care as always, without any other incidents.”
Was rescued by a Pingo Doce employee
It is also known through the same source that Emilia C. was immediately rescued by a Pingo Doce employee, and was later taken from ambulance to the hospital. As a consequence of the accident, Emilia began to feel “pain in the right hip, as she climbing stairs, bending or when making physical efforts.”

Almost six years after the occurrence, Emilia C., currently 69 years old and already renovated, will receive compensation of 35,000 euros. The news comes after the Supreme Court of Justice denied the fidelity’s appeal, the Pingo Doce insurer.
The insurance company in question intended to pay only 15,000 euros of compensation to Emilia C. for claiming that, although it does not undermine the facts described in the case file, “compensation for biological damage, in the aspect of non -heritage damage, cannot, nor should, exceed 15,000 euros.”
The insurer’s proposal was not accepted
What is certain is that the victim of this accident fractured an hip and underwent several treatments, including infiltrations, which consists of the application of a medicine directly to the affected structure, and surgery to place a total hip prosthesis. What is certain is that the Supreme Court has not accepted the proposal of loyalty and assured that the compensation to pay Emilia C. is even fixed in the 35,000 euros.
