The government published on Friday (7) ordinance creating a working group to discuss the aspects related to the economic development of the decision of the (Superior Court of Justice).
Hemp is a species of the cannabis family with a very low ThC (tetrahydrocanabinol) content. THC is the active ingredient with psychotropic properties.
The WG was created within the Council for Social and Sustainable Economic Development, the. The ordinance is signed by the Minister of SRI (Secretariat of Institutional Relations), who takes office as a new health holder next Monday (10).
The group’s coordination will be in charge of lawyer Patrícia Villela Marino, president of the Humanitas Institute360 and member of the council. According to her, the WG is important because “materializes the responsible capitalism of inclusive production with worldwide competitiveness and Brazilian technology”.
The STJ’s decision does not allow the importation of seeds and the planting of hemp from individuals. Nor does it authorize industrial uses beyond pharmacist and medicinal.
In the evaluation of Bruno Pegoraro, president of the Ficus Institute, who acts for the regulation of cannabis, hemp and psychedelic, the working group will contribute to efficient regulation and allow Brazil to become a relevant producer for the domestic and external market. “One of the main points is to include, in addition to medicines, production for fiber and food, which have great potential for agribusiness,” he says.
Rafael Arcuri, president of the National Association of Industrial Hemp, evaluates that the STJ’s decision also sets the thesis that industrial hemp cannot be prohibited because it is not considered a drug, since its low THC content does not produce psychotropic effects.
“As a result, the need for regulation of other industrial uses of the plant arises, because what is not prohibited is allowed,” he says. “But in many cases, even though it is not prohibited, it is necessary that bodies such as the Ministry of Agriculture create specific norms, such as vegetable health rules, registration of seeds and cultivars and traceability.”
