Braga Netto’s defense asked for twice the time to present the response to the Supreme. She also asked the deadline to start only after whistleblower Mauro Cid filed his prior defense in the process.
The lawyers say the changes would be necessary because the general’s defense did not have access to the full documents seized by the Federal Police during the investigation into the 2022 coup plot.
In the decision, Moraes says that the defense fears “ample access to the evidence already documented” and denied the requests.
“It is verified that all the documents mentioned by the defense of Walter Souza Braga Netto are attached to the file of PET 12.100/DF, as well as in the related procedures, in which ample access to the evidence was guaranteed,” he says.
