A lawyer from Brasilia included an unusual “congratulations” in a petition sent to the Pernambuco Court of Justice (TJPE). Délio Lins e Silva sent a photo of a birthday cake, congratulating judge Alberto Nogueira Virgínio for the five years of analysis of the case he is defending.
The document was filed on February 25 and argues that the waiting time is 60 months, or 1,825 days, which would be enough for a “mother to get pregnant, go through the entire gestation period and see her son walking alone.” It still mocked in the document that the past period would be necessary for the completion of a master’s or doctorate.
“It is a long time for a magistrate to judge a mere appeal without any legal complexity,” said the lawyer, who also evaluated the magistrate’s stance as an “insolence,” and would be “shame” if he were in his place to evaluate a process of “such simplicity.”
“Be sure excellence that the author, with each passing year, will always be remembering the eminent magistrate, celebrating and clapping in your praise. May God enlighten the slow path of inertia, ”he added.
Questioned by CNNthe TJPE stated that the judge will not position himself, “in obedience to the Organic Law of the National Judiciary (Loman), which prohibits members of the judiciary expresses, by any means of communication, opinion or information about process in processing.”
