The defense of Oswaldo Eustáquio released on Wednesday (12) opinion of the Spanish prosecutor against the extradition of the scholarship influencer. The request was sent by Brazil to the European country at the request of the minister, (Supreme Federal Court).
Lawyer Ricardo Vasconcellos used a social network to share the content of the document. “The victory is close, this is the opinion of Spain’s attorney Tereza Sandoval on the negative for extradition of Oswaldo Eustáquio,” said Vasconcellos.
The text released by the defense states that crimes under investigation in the Supreme Court, of violent abolition to the Democratic Rule of Law and Coup of State, are not provided for in the criminal legislation of Spain and, according to the document, are “supported by freedom of expression”.
The request for extradition of Eustáquio was formalized by Moraes in September last year, just over a month after the magistrate determined to include the name of the investigated in the red diffusion of Interpol, the international police fugitives channel.
Moraes ordered the arrest of the former president’s ally at the end of 2023 for encouraging and participating in demonstrations that asked for the coup against the inauguration of the President ().
