CPI recommends indictments and new legislation for manipulation of betting

The final report of the CPI of game manipulation and sports bets should be read and voted on Wednesday (19), in a meeting that starts at 2:30 pm. In the document, Senator Romário (PL-RJ), rapporteur of the CPI, asks for the manipulation of results. He is the uncle of the player Lucas Paquetá, former Flamengo athlete who currently plays in English football.

Romário also calls for the indictment of entrepreneurs William Pereira Rogatto and Thiago Chambó Andrade, also for crimes of results manipulation. The CPI decided not to indicate businessman Bruno Lopez, who confessed to participating in the manipulation of games, due to a closed agreement with the prosecutor.

“This CPI showed that virtually all recent competition manipulation scandals were related to bets on isolated events, especially those cases involving consecrated athletes,” says Romário in his report.

The senator added that these punctual bets would facilitate manipulations made by gamblers and criminal groups, without necessarily affecting the outcome of the match. He defended the restriction of this activity and recommended that sports entities inform athletes about the legislation in force and eventual punishments.

Proposed legislation

The final report proposes a constitutional amendment and three bills to curb game manipulation.

The suggested constitutional amendment makes it mandatory, when applicable, the attendance of any citizen in the parliamentary commissions of inquiry (CPIs), including the possibility of using police force. This proposal was presented after the Federal Supreme Court (STF) deciding that influencer Deolane Bezerra would not have to testify in the CPI of manipulation of games and sports bets.

The first of the three suggested bills increases the penalty of fraud crime for results at a sporting event: for four to ten years in prison and a fine. The project also establishes in the legislation the crime of fraud in the betting market; provides for punishment “for the athlete who provides relevant information not disclosed to the public that is used to gain advantage in this market”; and establishes the crime of dissemination or advertising of unrealistic gains in bets.

The other recommended bill provides for the obligation to warn the game’s discouragement and warning about their harms, to be conveyed by the operator agents.

In addition, the report proposes a third bill, aiming to restrict the offer of bets on isolated events that occur during sporting events.

All documentation produced by this CPI should be shared with the Federal Police and the Federal Prosecutor’s Office, so that the investigations continue. The information will also be sent to other institutions, such as the Civil House and the Ministries of Finance, Justice, Sport and Health, so that each one can take specific measures regarding their respective areas.
