Justice Minister Ricardo Lewandowski announced that the federal government reached consensus on the proposal for amendment to the Constitution (PEC) of public security and said the project is ready to be sent to the National Congress. Federal management will now hold meetings with the presidents of the House, Hugo Motta (Republicans-PB), and Senate, David Alcolumbre (Brazil-AP Union), to align when it will be the best time to send to Parliament.
The statements took place on Thursday, 13, after meeting with President Luiz Inacio Lula da Silva at the Planalto Palace. Among those present were also the Minister of Institutional Relations, Gleisi Hoffmann, and members of the technical area.
“There was the consensus of all present that, after a broad discussion of this PEC, not only with the governors, but with civil society and also with the academy itself, it would be mature to be sent to Congress,” Lewandowski told journalists, saying it was the last meeting of the government’s summit to address the content of the text. “This PEC intends, in general, to create a SUS of public safety,” he said.

He stated that the text did not change compared to the one presented in late February. At the time, the content of the project was expanded to include the municipal guards among the public security bodies provided for in article 144 of the Federal Constitution. Inclusion formalizes the role of these corporations in ostensive and community policing, recognized by the Federal Supreme Court (STF) in the same month. The thesis defines that municipal guards can perform urban security actions, provided they do not carry out criminal investigation activities.
According to the new text, the Municipal Corporation must act in an integrated manner with the Civil and Military Police, without performing functions of Judicial Police – which was determined by the Court. PEC highlights the need for regulation through municipal legislation and the supervision by the Public Prosecution Service. Lewandowski stated that municipal guards will do urban, ostensible and community policing.
