The (Supreme Federal Court) is about to resume, on the 26th, the judgment on the argument of non -compliance with the Fundamental Precept (ADPF) of the favelas. This trial is awaited with great expectation, especially by the governor of Rio de Janeiro, (PL), who sees the decision as a possible “birthday gift” as he turns 46 on March 29. The ADPF, which was implemented during the COVID-19 pandemic by the STF Minister, established a specific protocol for the performance of security forces in state communities and areas.

The measure, requested in 2019 by the Brazilian Socialist Party (PSB), has been the target of criticism, being seen by some as a factor that strengthened organized crime, including drug trafficking and paramilitary groups. The trial, which was restarted last month, was eventually interrupted after Minister Fachin’s vote. Since then, Cláudio Castro has kept a constant dialogue with the Rio de Janeiro bench and representatives of the judiciary about the favela ADPF.

Several sectors, such as industry, commerce and services, have also manifested themselves in the Supreme Court on the subject, with the intention of demonstrating the importance and impact that the STF’s decision may have on public safety and state economy. Security forces, in turn, expect the outcome of the trial, which can be completed in the last week of March.

The Governor’s pressure on the Supreme Court reflects the growing concern with violence and crime in Rio de Janeiro. There is an intense debate on whether ADPF serves as an obstacle to the effective action of the state government against organized crime. Minister Alexandre de Moraes, former Minister of Justice and Public Security, has already signaled that his vote may be favorable to the withdrawal of some restrictions, arguing that the police must have full power to act. ADPF does not prevent police operations, but imposes restrictions that are under discussion. The STF is expected to find a balance between allowing vigorous police actions and avoiding abuse.
