Judge Gamaliel Scaff of the Court of Justice decided to revoke the house arrest of Jorge Guaranho, former criminal police officer who was convicted of the murder of Marcelo Arruda, a municipal guard and treasurer. The crime occurred in July 2022, in during the victim’s birthday party, where Guaranho fired shots that resulted in the death of Arruda. Guaranho had been sentenced to 20 years in prison by the Curitiba Jury Court. After the conviction, he got a habeas corpus that allowed him to serve the sentence at home. However, the Public Prosecution Service of Paraná appealed to this decision, leading the judge to reevaluate the case and determine that the former policeman should return to the closed regime.
In his new decision, Judge Scaff argued that Guaranho’s medical needs could be met in the Pinhais Penal Medical Complex, where he must serve his sentence. This change of regime reflects the severity of the crime and the need to guarantee public security. Marcelo Arruda’s murder occurred in a context of intense political polarization. During the trial, Guaranho’s defense claimed that he acted in self -defense, but the version accepted by the court was that he attacked Arruda deliberately. The former police officer went to the party scene on two occasions, argued with the victim and then fired three times, resulting in fatal injuries. Arruda still tried to defend himself, but did not survive the injuries.
