Jury condemns 2 defendants for the death of Congolese in Rio in 2022

Alesson Cristiano de Oliveira Fonseca received the penalty of 23 years, 7 months and 10 days. Fábio Pirineus da Silva was sentenced to 19 years, 6 months and 20 days. It is still possible to appeal the defenses.

Both will have to serve the sentence in closed regime, according to the Jury’s judgment council. They were convicted of triple -qualified homicide, for futile, kind of cruel and impossibility of defending the victim.

According to the Rio Court of Justice, Moïse was assaulted with punches, stabbing and kicks by Fábio and Alesson, after an argument at the kiosk where Congolese served services, on the edge of, the upscale neighborhood of the state capital.

The victim was overthrown and immobilized by another accused, Brendon Alexander Luz da Silva, while assaulted by the 2 defendants convicted. In addition, Moïse had his feet and hands tied by wires. The crime was recorded by a Kiosk security camera.

Brendon has not yet been tried because he appeals from the pronunciation sentence and his name was dismembered from the original proceedings. The request is underway in the (Superior Court of Justice).

The jury that judged Alesson and Fabio began on the afternoon of Thursday (13.mar). 6 witnesses were heard beyond the 2 defendants.

The trial was interrupted on the night of that day and resumed on the morning of Friday (14.mar), for the debates between prosecution and defense. The sentence was read by Judge Thiago Portes shortly before midnight.
