The minister do approved last Wednesday (19) a significant agreement between the and Deputy André Janones. This agreement arises in the context of an investigation into a “crack” scheme, in which Janones was involved. The approval of the agreement represents an important milestone, as it allows the parliamentarian to avoid facing criminal proceedings in the Federal Court, provided that it strictly complies the established conditions.

Deputy André Janones was under investigation by embezzlement, accused of diverting public funds and using an advisor’s credit card for personal purchases between 2010 and 2020, without repaying the amount spent. In the non-criminal non-prosecution agreement, Janones formally admitted the crime and pledged to pay $ 131,000 to the House of Representatives as a way of repairing damages. In addition, he agreed to pay an additional $ 26,000 fine to an entity of social interest. The payment of R $ 131 thousand will be made with an entry of R $ 80 thousand in cash, and the rest will be in installments 12 times.

During the period of compliance with the agreement, Janones is prohibited from committing new crimes, under penalty of breach of the agreement with the Federal Supreme Court and the Attorney General’s Office. This agreement not only prevents Janones from faces criminal proceedings, but also establishes a precedent on how similar cases can be treated in the future. The acceptance of the agreement by Minister Luiz Fux means that Janones is no longer investigated, provided that he complies the determinations signed.

While Janones was able to avoid criminal proceedings, the situation is different for two of his advisers, who were also under investigation in the case of “cracks”. They did not accept the non -criminal agreement and, as a result, the investigation against them will go to the Federal Court. This means that they can face criminal proceedings, highlighting the complexity and different legal branches that may arise in cases of corruption and embezzlement of public resources.
