The Supreme Court Minister (STF) Alexandre de Moraes denied the appeal of former Deputy Daniel Silveira against the decision that revoked his parole in December.
Silveira’s appeal began to be analyzed in a virtual plenary this Friday (21). The other ministers have until next Friday (28) to vote whether they agree with Moraes or not.
In a vote, the minister – who is the rapporteur of the action – stated that the defense did not present any arguments capable of refuting the grounds made in previous decisions.
“There is no illegality in the decision that maintained the revocation of the sentenced conditional release benefit, given the unequivocal demonstration of non -compliance with several occasions of the conditions set,” said the minister.
In December 2024, Moraes granted Conditional Freedom to Silveira. In the decision, the minister determined conditions such as the use of an electronic anklet and being at home at night, from 22h to 6h.
Four days later, the benefit was repealed and Silveira returned to the closed regime for violating the collector.
According to Moraes, the former deputy disregarded this condition upon returning home at 2:10 am on 12/22, or more than four hours after limit time.
At the hearing, the defense claimed that Silveira had an emergency and had to go to the hospital. However, the registration of the electronic anklet showed that the former deputy was in a hospital until 00h44.
When he left the scene, he went to a condominium in Brasilia, where he remained until 01:54. This information was omitted by the defense.
The former deputy was sentenced to 8 years and 9 months in prison for threats to the Democratic Rule of Law and incitement to violence against STF ministers. Silveira has been arrested since February 2023.
