While his defense works for appeals in the Supreme Court (STF) and the Supreme Court (STJ) to modify the penalty determined by the Italian courts, on the grounds that there is a difference in the legislation of the two countries and that dosimetry should be adapted to what Brazilian criminal law says, the former athlete bets on good behavior and courses to reduce his prison time.

The former player has always denied that he committed the crime. Shortly before being arrested in March 2024, he even published a video on his social networks in which he showed photos and prints that, according to him, would prove his innocence.

In addition to its representatives, Robinho has received regular visits from his family members. The list of those who ever went to the prison to see it is not disclosed by SAP (Secretariat of Penitentiary Administration), but there have been those who publicly express his desire to visit him, such as former coach Emerson Leão.

Rudney was a private security of Robinho and was one of those reported by the prosecutor of Italy for involvement in the case of collective rape against an Albanian woman, but was not convicted of the crime.

He and three other men were not tried by the Italian court because they left the country during the investigations and were not notified for the preliminary hearing, which took place on March 31, 2016.

In addition to Robinho, Ricardo Falco was also convicted by the Italian court. The condemnations of the two were determined in the third and last instance, ie no further possibility of appeal.

Falco fulfills his sentence in Guarulhos Penitentiary 1, in Greater São Paulo. P1, as it is called, was chosen for concentrating a profile of prisoners similar to those of Tremembé.

Lorena Machado, Falco’s lawyer, said the case if her client follows in the courts a similar course to Robinho, both in the STF and the STJ, but are in different procedural stages.
