Dino votes to condemn Zambelli for illegal possession of a weapon; scoring is 4×0

Minister Flávio Dino of the Federal Supreme Court (STF), for illegal firearm crimes and illegal embarrassment with firearm use.

The magistrate accompanied the rapporteur of the case, Minister Gilmar Mendes, and the ministers Cármen Lúcia and Alexandre de Moraes.

Gilmar proposed that the penalty is 5 years and 3 months in prison for the parliamentarian. In the vote, Dino noted that another consequence of the crimes would be “the loss of office, civil service or elective mandate.”

The trial takes place in the virtual plenary and the ministers have until Friday (28) to record their votes.

To form a majority in the conviction, it would be necessary for at least two more ministers to follow Gilmar’s vote.

However, if the magistrates decide to acquit the deputy, the process will be filed.

Remember the case

In August 2023, the Supreme Court became the deputy to have, considered a supporter of President Luiz Inacio Lula da Silva (PT).

The case happened on the eve of the second round of the 2022 elections, through the streets of Jardins, a noble neighborhood of São Paulo.

Videos of the moment began to circulate on social networks. Zambelli then posted a recording and claimed that a group of men would have tried to intimidate her, and said she was pushed to the floor by one of them.

According to her, the gun was pointed to stop the men until the police arrived.
