The lawyers of General Walter Braga Netto, former Minister of Defense and Civil House in the Jair Bolsonaro government, sent on Monday, 24, to the Supreme Court (STF) a synthesis of the defense arguments to try to convince the ministers of the first class to reject the complaint of the coup.
The memorial summarizes in ten pages the argument of the prior defense – 173 pages – sent to the Supreme Court earlier this month.
Lawyers José Luis Oliveira Lima, Rodrigo Dall’Acqua, Rogério Costa, Millena Galdiano and Bruno Dallari Oliveira Lima, who represent the former minister, state that the complaint is “contradictory, fantasy and admittedly without commitment to the evidence” and that “the procedures that preceded him with various illegalities”.
“Given all this scenario, the need for this E. STF, with the wisdom and serenity that are peculiar to it, reject the reckless accusations articulated against Gen. Braga Netto,” says the defense.
Braga Netto was appointed as one of the leaders of an armed criminal organization that, according to the Attorney General’s Office (PGR), was set up to keep Bolsonaro in power after defeat in the 2022 elections.
According to the complaint, he funded an operation to execute Minister Alexandre de Moraes – the Plan Copa 2022 – and made the dialogue with radical supporters of Bolsonaro who were camped in the barracks.

– “fragile” and “evaded” tests: The defense claims that it did not have access to the entire probative collection of the investigation and states that the PGR did not individualize the conduct of the accused;

– Mauro Cid’s award -winning collaboration agreement: The defense points to “countless inconsistencies” in the Lieutenant Colonel’s versions and states that Minister Alexandre de Moraes “extrapolated the legal limit” by conducting one of the hearings of the agreement;
– Addiction at origin: The defense states that the investigation of the coup is irregular because it was opened based on the digital militias investigation. The investigation of the digital militias was instituted by Minister Alexandre de Moraes from the sharing of evidence of the inquiry of non -democratic acts, filed at the initiative of PGR. Braga Netto’s lawyers claim that the minister acted irregularly by having investigated facts that had been given as closed by the Attorney General’s Office.
