Technical area of the agency speaks of possible irregularities in the agreement so that the international entity organizes COP30
The Technical Area of the Federal Court of Audit (TCU) has asked the government to explain the contract signed with the Spain (Ibero-American States Organization), to organize COP30 (United Nations Conference on Climate Change) in Belém (PA). According to the agency, there are possible irregularities in the agreement, which.
Had access to the TCU document of 18 March. In it, the agency says that “The lack of information about the criteria that underpinned the contracted value, coupled with the financial magnitude involved, reinforces the need for diligence to the jurisdictional unit, so that detailed clarifications on the composition of the value are presented.”.
O Poder360 It contacted, by email, with the TCU and the press office of the Civil House and Secom (Secretariat of Communication of the Presidency of the Republic) to ask about the document and if there was a response by the government. There was no answer until the publication of this post. The space is still open to demonstrations.
As it is an international organization, there was no bidding process – or that is, OEI was chosen discretionary by the Federal Government. The contract was signed in December and is valid until June 30, 2026.
The TCU asked the government to explain “If there has been comparative analysis with market prices for similar services, including eventual quotes or studies that underlie the amount, and the objective criteria that demonstrate the economy of OEI’s choice in relation to other available alternatives”.
The technical area of the agency said that there is “significant discrepancy in the approach adopted by Brazil” in the organization of COP30 regarding the previous conferences.
“Unlike previous editions such as COP26 (United Kingdom, 2021) and COP27 (Egypt, 2022), which used partnerships with the private sector and wide competition, the federal government opted for a direct hiring model, without bidding process ”read in the document.
“The diligence already proposed within this representation have precisely the objective of clarifying the reasons that led to the adoption of this direct hiring model, to the detriment of alternatives that prioritize competition and the participation of the private sector, as observed in the previous COPs, being unnecessary, at this time, the formulation of new specific measures on the subject”Says the text.
The TCU asked the government to explain “the criteria and justifications of choiceOf OEI, since “there is more than one international organism of which the Federative Republic of Brazil is member”.
The agency mentioned that, although the contract was signed on December 18, 2024, a payment was made to OEI in August of that year. Another, on December 23rd.
“These values, totaling R $ 20.7 million, suggest the possibility of early execution of the object of the contract before its formalization or the existence of another non -declared contractual instrument, which compromises the legality and transparency of the process”He said.
The Court spoke of possible mis requested resources and improper influence.
“The representation also highlights the absence of elements that demonstrate the economic adequacy of hiring, which may suggest, in theory, a possible mismanagement of public resources, violating constitutional principles such as efficiency and economy, provided for in Article 37 of the Federal Constitution”He said.
Were present in the signing of the contract:
- Valter Correia, Extraordinary Secretary for the COP30 of the Civil House of the Presidency of the Republic;
- Rodrigo Rossi, director of OEI in Brazil.
Rossi took office in July 2024. He entered the place of Leonardo Barchini, who became executive secretary of the MEC (Ministry of Education).
In the management of Rossi, OEI contracts with the Lula administration jumped: there were 5 agreements in the 2nd semester of 2024 alone.
“Given the suspicions of favoring the organization of the American Ibero States (OEI) pointed out in the representation, involving Leonardo Bardii, which occupied the direction of OEI between September 2023 and July 2024 and assumed the executive secretary of the Ministry of Education (MEC) on 7/31/2024, it is a fact that the pointed exponential growth of spending with the organization-R $ 17.4 million for a projection of R $ 17.4 million for a projection of R $ 676.1 million until 2025 – raises serious questions about possible improper influence”Said the TCU.
The agency wants the government to send:
- the entire content of the hiring process regarding the OEI signed on December 18;
- justifications for choosing an international organism, demonstrating the unfeasibility of using the structure of public administration;
- the criteria and justifications of the choice of OEI for the agreement over other organizations;
- detailed clarifications on the composition of the estimated value of R $ 478.3 million;
- Information on possible comparative analysis with market prices for similar services;
- Clarification on payments to OEI of R $ 5 million on August 26 and R $ 15.7 million on December 23;
- Name of a formal interlocutor who knows the matter to extinguish any doubts.
