It is not uncommon for personnel departments to be faced with the problem that employees work more than legal. Can this justify a discharge? Recently, the Supreme Court (OGH 22.01.2025, 9oba101/24d) had to answer exactly this question: A worker repeatedly performed work on Saturdays. Work on Saturdays is generally no longer permitted from 1 p.m. (at most from 3 p.m.), because from there, weekly deletions must be kept (§ 3 ARG).
