The Supreme Court Minister (STF), Gilmar Mendes, defended on Monday, 24, that new rules are established for the remuneration of the judiciary. He stated that Brazil is experiencing a “real disorder frame” when it comes to the court’s supersalaries and suggested a debate on the part of the government.
The statement took place at an event organized by the Federation of Industries of the State of São Paulo (FIESP) and the National Confederation of Industry (CNI).
“It seems fundamental to me that there is a discussion about this theme. We are experiencing a picture of true disorder. All the time the newspapers print new hangers and bonuses. Rules and norms must be established for it,” said the STF dean.
He cited the 2004 judiciary reform, made possible through Constitutional Amendment 45, and the way his provisions on subsidies became outdated.
“There was a huge effort to close with the hanging, creating subsidies. But in Brazil, even considering the speed of times, the subsidies were surpassed. In this context, new bonuses were generated, or old gratifications have been restored, and we are in an extremely worrying phase, where we do not know what the criterion should prevail,” he said.

The high remuneration of judges and judges were approached by court ministers during trial in the first class of the Supreme Court last Tuesday, 18. Flávio Dino stated that the increase in salaries of judges and judges is the result of “administrative creativity” that “embarrasses the judiciary”.
Minister Cármen Lúcia said that the maneuvers that allow payments violate not only the judiciary, but the constitutional rules and the right of the citizen.
In December 2024, state courts and branches of the prosecutor used cash leftovers to grant benefits that raised salaries by up to R $ 524 thousand grosses. In the courts alone, amounts were paid that total at least R $ 1.5 billion, according to the National Council of Justice (CNJ).

In a more recent process, the CNJ analyzes the regularity of the retroactive payment of an indemnity for “collection of collection” to magistrates of the Paraíba Court of Justice (TJPB). The decision resulted in a “superpendurical” of $ 234 million.
