An opinion in elaboration by the (Attorney General of the Union) provides for a guarantee of structure for the performance of the first lady Rosângela da Silva, a, with accountability, but without the creation of a position to perform these functions.
From the text under preparation, the State will have to guarantee structure and support for voluntary and unpaid work of the first lady, and the presidency must define accommodation and team size.
The public agenda of the first lady and costs with her team, as well as Janja expenses in institutional activities, must be published. These expenses should also be included in the Transparency Portal, and is also available via the Law of Access to Information.
Without formal position, Janja cannot be summoned for clarification to the National Congress. Personal activities will not be disclosed.
She cannot make commitments on behalf of the government. It may, however, represent President Lula in cultural activities, for example.
Union attorney General Jorge Messias recalls that the spouse of the President of the Republic, traditionally, fulfills “a function of a symbolic representative character of a diplomatic social cultural nature”.
The writing of the opinion is endorsed by the presidency of the Republic and inspiration on models from other countries, such as USA and France. The (Federal Court of Audit) and the Public Prosecution Service were also consulted.
As the Monica Bergamo column anticipated the AGU on the role of the President of the Republic’s spouse in the country. Text released by AGU says that with the opinion, “hopes to give legal basis and leave clear the possibilities and limits of the performance of the first lady or the first groom, prevent it from being the subject of legal demands and political attacks.”
The document must be transformed into a normative orientation for the function of the spouse, being legally linked to the Federal Public Administration.
Messiah has discarded the need to create positions and says there will be no gambiarras. The idea, according to him, is to define the structure provided by the State to the spouses of the Presidents of the Republic, besides setting obligations such as accountability and advertising of the agenda.
The document is being made after opposition pressures regarding Janja’s participation in federal government events and activities.
Sought, the AGU replied that it will disclose the opinion as soon as it is completed. According to the agency, the document aims to define the parameters of the performance of spouses of the Presidents of the Republic (First Lady or First Girl) in national and international events in which they symbolically represent the head of state and government.
The Minister of Institutional Relations, () defended, last Friday (21), the creation of a “honorary position” for Janja, so that she could continue her participation in a recognized way and facilitate the accountability-also questioned by the opposition wing.
Spending on Janja tickets and their event team are among the main points of criticism of management. On the official trip of the first lady for Rome in February, the Presidency of the Republic she had been designated by Lula for governance of the International Fund for Agricultural Development.
Since 2023, there is one around Janja’s commitments, appearances and statements, whose presence on Lula’s official agenda has intensified during the term.
This year, the first lady started to disclose her official agenda through stories in her Instagram account, although she has no legal obligation to disclose a public agenda, as she does not hold an official position.
