Celso Vilardi praises the minister’s position by questioning the disimestry of the January 8 penalties and a crime of attempted coup
Former President Celso Vilardi’s defense lawyer praised the arguments of Minister Luiz Fux at the trial he made Bolsonaro and 7 more former defendants on Wednesday (26.mar.2025).
The compliment refers to Fux’s questioning regarding the 14 -year sentence dosimetry judged by January 8. Also to the fact that the PGR (Attorney General’s Office) and the ministers treat a. The understanding of the ministers is that if the crime were consummated, there would be no way to punish it, since the current order would change.
“Minister Fux made an absolutely correct position, not only about dosimetry, but especially on the question of the 2 offenses that are being imputed. Because in the vote of Minister Barroso there is a conflict between these offenses, but this is not the time. Let’s go to the defense, thank you.”Vilardi told reporters after the trial end.

The minister was also the only one of the other ministers about one of the preliminaries requested by the defenses. He considered that the plenary formed by 11 ministers should judge the accused.
JUDGMENT
Fux’s speech was during the trial that evaluates the receipt of the complaint of the PGR (Attorney General’s Office) for attempted coup.
The President of the 1st Class, Cristiano Zanin, 3 extraordinary sessions to consider the complaint: two have already taken place on Tuesday (25.mar), 9:30 am and 14h. The last one was this Wednesday (26.mar), at 9:30 am.
The trial refers only to the 1st of the 4 accused groups. It is the central core of the criminal organization, of which, according to investigations, the main decisions and social impact actions came. Are in this group:
- Jair Bolsonaro (PL), former President of the Republic;
- (PL-RJ), former director general of ABIN (Brazilian Intelligence Agency) and federal deputy;
- Almir Garnier, former Navy Commander;
- Anderson Torres, former Minister of Justice;
- Augusto Heleno, former minister of GSI (Institutional Security Office);
- Mauro Cid, former Bolsonaro orders of orders;
- Paulo Sérgio Nogueira, former Minister of Defense; and
- former minister of the Civil House and candidate for vice president in 2022.
Next Steps
If the complaint is accepted, a criminal action begins. At this stage of the process, the Supreme will have to hear the witnesses indicated by the defenses of all defendants and conduct their own investigation. After the steps, the Court opens overlooking the final allegations, when it should ask the PGR to comment on the acquittal or conviction of the accused.
