In the decision, Judge Natasha Gabriella Azevedo Motta said that the complaint does not point to individualized conduct of those responsible for the act, which did not allow its broad defense.
The magistrate also understood, in her decision dating from 21 March, that witnesses listed by the prosecution did not ratify the versions presented by civil and military police who were at the scene on the day of the action.
In addition, he said that “they did not point out the leaders of the invading movement and its other members, not knowing how to point out those responsible for the damage and subtractions, with the slightest report of the performance of each of its agents.”
According to Roberto Rainha, MST’s lawyer, the decision is “an important milestone against the criminalization of movements and social struggle.”
