The minister of (STF) voted on Wednesday (26) for accepting the (PGR) complaint against the former president and seven other accused of trying a coup after the 2022 elections. The former president denies involvement with the plot.
According to Moraes, there is just cause and evidence of sufficient authorship and materiality to put Bolsonaro and his allies in the defendants. In the rapporteur’s assessment, the evidence produced by the Federal Police throughout the investigation of Operation Tempus Veritatis would already be “sufficient”, but there are several testimonials by Lieutenant Colonel Mauro Cid, former Bolsonaro orders, corroborating the investigators’ findings.
Now, the other members of the first class of the Supreme Court, a board who analyzes the imputations against the former president and other accused, will present his opinions on the complaint. In the following order, the ministers vote: Flávio Dino, Luiz Fux, Cármen Lúcia, and Cristiano Zanin, president of the class.
If the Supreme Court makes Bolsonaro defendant, the criminal action against the former chief executive will begin. Only at the end of the whole process, which includes a series of hearings and diligence -which can be required by both prosecution and defense -the judgment that can sentence Bolsonaro will be marked.
The PGR accuses Bolsonaro of crimes of attempted violent abolition of the Democratic Rule of Law, coup, armed criminal organization, damage qualified by violence and serious threat against the union’s assets and deterioration of listed heritage. The agency told the complaints offered against the 40 indicted for the attempted coup d’état. The accusation that hits Bolsonaro is the first to be analyzed by the Supreme Court.
