The first class of the Federal Supreme Court () resumes on Thursday (27) the judgment of the complaint against the former president and seven others accused for attempted coup. The session will be marked by the vote of the rapporteur, minister, who will analyze the merits of the complaint and will comment on the opening of criminal action against the investigated.
In the first session, held on Tuesday (25), were presented the arguments of the Attorney General’s Office (), the defenses of the accused and discussed procedural issues. The Attorney General of the Republic, Paulo Gonet, pointed out that the complaint points to a coordinated action to shake democracy, citing episodes such as the attacks on the electronic ballot box, the July 2022 ministerial meeting and the military intervention camps. According to Gonet, there are elements that prove the existence of a criminal organization focused on institutional rupture.
The defenses contested the accusations and raised preliminary questions, such as the supposed incompetence of the Supreme Court to judge the case and the nullity of the award-winning collaboration agreement of Lieutenant Colonel Mauro Cid. These arguments were rejected by most ministers, except for Luiz Fux, who argued that the trial be taken to the court plenary.
With the rejection of preliminaries, the Supreme Court advances for the analysis of the merit.
