During the second day of and seven other accused for alleged attempted coup d’état, the ministers Flávio Dino and Cármen Lúcia of the Supreme Court (STF), returned to laughs in the plenary of the first class by bringing the ages of the magistrates for the debate.
The moment occurred after Minister Alexandre de Moraes, who remembered a 2018 maneuver in Poland to reduce, retroactively, from 70 to 65 years old for compulsory retirement of the local Supreme Court judges.
The purpose of this change, according to Moraes, was “To remove the five judges that were contrary to the unconstitutional measures ”imposed by the executive and legislative powers of Poland.“ This is an attack on one of the powers, but it is not a coup, because the political powers continue. ”
“I, as I will do 60, declare myself right away against this hypothesis, because I am close to the incidence of this attempt.
“Your excellence first,” said Moraes, smiling.
At this moment, Cármen Lúcia, who is the dean of the first class, intervened, directing the word to Dino: “You are having a problem with age.” Dino replied, “It’s because of the weight. In me.”
Cármen Lúcia is 70 years old, while Dino is 56. By current legislation, compulsory retirement in the Supreme occurs at 75 years.

In his speech, commenting on procedural issues of the action, Carmen, which is the dean of the first class, referred to 2007, when the Supreme Court accepted the complaint against the accused in the case of the monthly.
Then Dino asked the word: “Minister Cármen, before you conclude you, your excellence alluded to another moment of the court in 2007. And I want to take advantage of this record to honor the forerunner of a figure who today works in virtually all Brazilian courts, who is the assistant judge. I remember well, I was a federal deputy at the time.”
Carmen answered his colleague by saying that she was already in the Supreme at that time – she took office in the court in 2006. Dino then said that at the time, she had “recently completed the law course”, causing laughter in the audience.
“Look, minister. You have already indicated that I am the dean of the class, I can not even say anything. The other has already indicated the old ladies. Today I am a preferred target,” said the dean.
Then Carmen added: “I will rectify that if you were already here with Minister Nelson Jobim, I succeeded Minister Nelson Jobim.” The statement was made by the fact that Dino remembered that he acted as an assistant judge in Nelson Jobim’s office, who retired from the court in 2006.
“It means that you were not forming. There is a small lapse in the calendar. You should neither be as new as it says nor am I as old as your excellence imagines,” said the minister, who again laughed in the plenary.
